Referring to our earlier announcement Oct 27, related to the temporary customs order, we would like to inform clients of Containerships as follows:

- Since week 44 and up to year end, customs authorities apply strict verification of documentation on all cargoes which are not immediately import customs cleared at arrival port

- Shippers are recommended to avoid bonded trucking to final destination in Russia but instead arrange clearance of cargo at Baltic Customs

- Translation of the related Customs Order is available as appendix

APPENDIX

About measures on customs control strengthening during declaring and release of the cargoes under customs procedure of customs transit.

In order to strengthening the control over reliability of data in documents provided to customs for goods placed under a customs procedure of customs transit, and also in order to prevent infringement of the customs legislation of the Customs Union I oblige:

1. in view of: frequent cases of the statement of doubtful data about classification code, weight of the declared goods, understating customs value of the goods and to prevent possible losses of the federal budget Chiefs of customs posts Kronshtadsky, Turukhtanny, Lesnoy port, Gavan`, Pushkinsky are to:

1.1. Provide check of correctness of classification of the goods. In case of revealing of discrepancy of data on a classification code and the description of the goods, to carry out application of necessary measures within the limits of Russian Customs legislation in order to identify the goods, and to direct information on the declared code of the goods according to Harmonized codes nomenclature of foreign-economic activity for decision-making in “Department of the commodity nomenclature and an origin of the goods of the Baltic customs”.

1.2. After registration of the transit declaration before decision-making on release of the goods from the terminal, to carry out the comparative analysis of data on weight, a classification code, costs of the goods declared in the transit declaration, with the information on a classification code, weight and cost the similar goods, that were customs cleared at the Baltic customs for internal consumption.

1.3. In case of revealing of a divergence of data on the goods, provided by the point 1.2. of this order, in time, not exceeding two hours after release of the goods, to direct the corresponding information to customs post of final clearance (both to the chief of customs post, and to the chief of a region customs). The specified information goes in written form, under the form in attachment to this order, signed by the chief of customs post.

1.4. The information about the released goods to transfer via communication channels (e-mail, fax), the copy of the report of information to attach to complete sets of the issued transit documents transferred in department of customs transit control of the Baltic customs, with obligatory inclusion in the list of documents.

1.5. Data about all consignments, released according to a customs procedure of customs transit, daily, at the end of a labor shift, to direct in department of customs transit control of the Baltic customs under the form, in attachment № 2 of this order. The information to direct by e-mail with the subsequent message through department of documentary maintenance of the Baltic customs.

2. Head of Control over customs transit procedures Department is to weekly provide information about all released under customs control declarations to 1st deputy of Baltic Customs Head on customs control.

3 Implementation of the measures set by this order are not contradicting with the period that set up by clause 196 of Customs Code of Russian Federation.

4 The order is not applicable for following categories of the goods:

4.1 Goods directed to Kazakhstan, Belarus.

4.2 Goods for compulsory customs clearance at dedicated customs bodies;

4.3 Goods that transported under customs procedure using TIR carnet.

4.4 Goods that declared by individual persons

4.5 Goods consigned to diplomatic, council institutions, international organizations of the Customs Union members;


4.6        Goods, required for liquidations of consequences of a natural disasters, extraordinary situations of natural and technogenic character, products of military purpose, required for piece maintenance or military exercises, humanitarian or technical aids; radioactive materials, postal deliveries, express-cargoes;

5          The order is put in force as from the signing and in force upto 31 December 2011.

6          Control over the order is on the 1st deputy of the Baltic Customs Head the lieutenant colonel of customs service I. Nitsenko.
